New Zealand is making it easier for migrant workers to transition seamlessly into their new roles while awaiting their Accredited Employer Work Visa (AEWV) decision. From 8 April 2025, significant changes will come into effect, granting work rights to more interim visa holders. These changes will provide greater flexibility and stability for migrants and their employers.

Key Changes to Interim Visa Work Rights

Currently, individuals on interim visas often face employment restrictions while waiting for their AEWV applications to be processed. However, under the new regulations, interim visa holders will now enjoy enhanced work rights if they apply for an AEWV while holding either:

  • Any type of work visa, or

  • A student visa that allows work during term time.

This update ensures a smoother transition for migrant workers and benefits both employees and accredited employers.

What This Means for Interim Visa Holders

With these changes, interim visa holders will gain the following advantages:

  • Faster Job Transitions – Applicants can start working in the job specified in their AEWV application, as long as it is linked to their Accredited Employer’s Job Check. This eliminates delays and allows workers to begin their roles sooner.

  • Work Experience Counts for Residency Pathways – The time spent on an interim visa with work rights will count toward the work experience required for work-to-residence pathways, helping migrants meet eligibility requirements more efficiently.

  • Clarification on Maximum Stay Duration – For individuals applying for a second or subsequent AEWV, time spent on an interim visa with work rights will be included in the maximum period they can stay in New Zealand on an AEWV. However, any time spent on an interim visa granted before the applicant’s first AEWV will not be counted.

Why This Matters

This policy change reflects New Zealand’s commitment to supporting skilled migrant workers and ensuring a more seamless employment process. Employers will benefit from a more stable workforce, while visa applicants can continue working without unnecessary disruptions.
